Foundational Principles
1. Stay out of court- go to court when you have settled and then to enforce
If this is a foundational principle, it changes the whole way we approach the challenge. It shortens the process and saves you money.
We sometimes have to act now to prevent legal problems in 20 years time.

2. If you are in a legal fight, take ownership, knowledge of substance and process- you are the owner, the lawyer is the agent, you decide everything on his/her advice.  Intelligent knowledgeable and informed clients win cases.

3. Law and the application thereof, is complex and multi faceted…our law is based on 100’s of years of study and application. A well drafted contract e.g. will diminish complexity, create certainty.

4. Make sure your legal adviser knows #1 and 2 and 3, and in particular believes in principle no 1. This creates pressure and brings about a solution- finding mindset, a solution-based mindset, and a movement away from a getting stuck in lengthy legal processes.

5. Know that, except in extraordinary cases, when you are litigating, its never good to change your lawyer.
Work towards consistency of the team.
What is your contract with your lawyer.

6. Your lawyer is human with all the frailties, projections and illusions you would  suffer from in his/her situation and which you live out in your business.

7. They call it grudge money, don’t begrudge your lawyer his fees, he did not start the issue.

8. Seek a win win…Covey and Sun Tzu, if your opponent is  a win lose person, its a no deal, you must fight  if attacked, find lateral solutions in your legal and physical environment. 
 
The win win solution is dynamic and often not the resolution you foresaw.

9. The application of law to the facts can be likened to a  war, not in the sense of blood and guts and glory, but in the sense that it is a strategic game where the gem is a win win.

The way Coach Willem Fourie teaches, to find a win win you have to determine what is a win for you.
This opens up an often richly rewarding seam of strategic thinking on what is a win for you given the total context, and how to reach your win and a win for the other side.
No win on the other side often leave festering wounds.

10. God is in the detail of that environment- this is the happy resolution, When you find it it is happy hour.
You lawyer must actively seek solutions in the law. A  specific factual scenario is never based on a single legal principle, but in a web of inter-locking laws and legal principles. Each must be identified and worked through for a resolution on a win win basis

My ask: remember to look-out for clients friends family who face personal and business challenges where application of these principles may bring relief.
Any personal and business challenge has legal edge to it which will often if explored bring relief.
It is a game where we look for people who may be served by me or other members, and the gems are a strong referral, a happy client, personal satisfaction of a job well done, a stronger chapter.
